Unauthorized Use of Images

An actor’s or Models’ image is her/his trade, just like a photographer’s or a film maker’s. The misappropriation or unauthorized usage of such an image can cause result in serious, career-damaging conflicts for the victims. This sort of misappropriation is all too frequent in the industry, and is considered a form of theft. Luckily it is subject to some effective legal remedies.

If a company or a brand uses your likeness, name or image in its advertising, promotions, or other material without first obtaining your consent, you may have a claim under California’s misappropriation of image statute, which has codified the remedies available to you, such as the right to prevent further misappropriation, profits derived by the brand, and money in the form of damages and attorneys’ fees.

If you are a photographer, the unauthorized use of an image you created can be enforced by way of an action for copyright violations, which is based on Federal law.
